Terms of Service

1. Who you are contracting with

These Terms of Service ("Terms") form a binding agreement between you and Vaise Patu("we", "us", "our"), the operator of the "My Vitals Log" application (the "App"). By creating an account or using the App you agree to these Terms.

2. The service

The App is a personal wellness journal that lets you log blood pressure, temperature, weight, and upload clinical report images for AI-assisted text extraction and summarization. The App is provided on a subscription basis with a free tier limited by feature access.

3. Eligibility & account

You must be old enough to enter a binding contract in your jurisdiction. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it updated.

4. Acceptable use

You agree not to:

• use the App for any unlawful, fraudulent, or harmful purpose;
• upload content you do not have the right to upload;
• infringe any intellectual property or privacy rights;
• attempt to interfere with the security or integrity of the App (malware, probing, scraping, reverse engineering);
• resell, sublicense, or redistribute the App without our written consent.

5. Intellectual property

The App, including its software, design, branding, and documentation, is owned by Vaise Patu and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the App within the plan you have subscribed to. You retain ownership of the content you upload (your health logs and report images); you grant us a limited license to host and process that content solely to provide the App to you.

6. Payments, subscriptions, refunds & taxes — Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's customer terms apply to your purchase: paddle.com/legal/checkout-buyer-terms.

Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. You can cancel at any time and will keep full access until the end of the current paid period. Refunds are governed by our Refund Policy.

7. Suspension & termination

We may suspend or terminate your access to the App at any time if you: (a) materially breach these Terms, (b) fail to pay any amount due, (c) create a security, fraud, or abuse risk, or (d) repeatedly or seriously violate our policies. You may stop using the App and delete your account at any time from the Settings page. Sections that by their nature should survive termination (IP, liability, disputes) will survive.

8. Medical disclaimer

The App is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. AI summaries are informational only. Always consult a licensed healthcare professional for medical advice.

9. Warranties & liability

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the App is limited to the fees you paid us (or to Paddle on our behalf) in the 12 months preceding the event giving rise to the claim. We exclude liability for indirect, incidental, consequential, or special damages (including lost profits, data, or goodwill). Nothing in these Terms excludes liability for fraud or for any liability that cannot be excluded by law.

10. Indemnity

You agree to indemnify and hold us harmless from claims arising out of content you upload, your unlawful use of the App, or your breach of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the App or by email. Continued use of the App after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Vaise Patu is established, without regard to its conflict of laws principles. Disputes will be resolved in the competent courts of that jurisdiction, subject to any mandatory consumer protection rights you may have where you live.
